TERMS & CONDITIONS

In participating I agree to use Hitting Targets Pty Ltd (Hitting Targets) equipment, services and facilities in compliance with the Rules on the following terms and conditions:

RULES:

• 1. You must not be under the influence of alcohol or illegal drugs to participate.
• 2. Hitting Targets reserves the right to immediately cancel any clay target shooting activities at any time if there is a breach of zero alcohol consumption or illegal drug use or, in the event that Hitting Targets is reasonably of the belief that the zero alcohol consumption or illegal drug use has been breached.
• 3. Hitting Targets further reserves the right to immediately cancel all clay shooting activities at any time if in the reasonable view of Hitting Targets, a participant or participants is causing danger or intimidation to or likely to cause danger to that participant, other participants, instructors or the general public within the facility grounds.
• 4. If a clay target shooting activity has been cancelled in accordance with rules 2 or 3 hereof there will be no refund to the offending or suspected parties – eg. individuals in a public session or if a private booking then the entire group.
• 5. Participants must either have an Australian Firearms License or Minors permit or be approved via a P650 form to participate.

RISK WARNING:

I am aware that my use of the equipment, services and facilities and in particular the use of shotguns supplied by Hitting Targets for clay target shooting activities can be inherently dangerous and serious accidents can happen which may result in me being injured or even killed or my property damaged.

ACKNOWLEDGEMENT OF RISK:

I declare that I have read and understand the risk warning and I accept and assume all such inherent dangers and risks involved in my participation of clay target shooting activities with Hitting Targets.

EXCLUSION OF LIABILITY:

Except to the extent that the Trade practices act 1974 (Cth) and the Fair Trading Act 1999 (NSW) or other legislation applies, and cannot by contract be excluded, I acknowledge that I am a consumer of recreational services, as defined by any relevant law, and as such certain terms and rights usually implied into a contract for the supply of services may be excluded. I acknowledge that these implied terms and rights in any liability of Hitting Targets flowing from it, are expressly excluded to the extent possible by law by this declaration. To the extent of any liability arising, the liability of Hitting Targets will at the discretion of Hitting Targets be limited to the resupply of the services or payment of the cost of having the services supplied again.

RELEASE AND INDEMNITY:

I agree that as a term of my participation in the use of Hitting Targets services and clay target shooting activities:

• (i) I RELEASE Hitting Targets from all liability howsoever arising from injury or damage howsoever caused arising out of my participation in any clay target shooting activities organised by Hitting Targets of which I am a participant.
• (ii) I INDEMNIFY and will keep indemnified Hitting Targets to the extent permitted by law in respect of any claim by any person including but not limited to another participant in the clay target shooting activities arising as a result of or in connection with my participation in any clay target shooting activities or from the use or attempted use by me of any Hitting Targets equipment services and facilities.

MEDICAL TREATMENT:

I CONSENT through participating to receiving any medical treatment that Hitting Targets reasonably considers necessary or desirable for me during my participation in the clay target shooting activities. I agree to reimburse Hitting Targets for any costs or expenses incurred in providing me with medical treatment. If you are in doubt whether you can shoot please get checked by your GP prior to booking in.

ALCOHOL & DRUGS POLICY:

We enforce a strict ”No Alcohol & No Drugs” policy prior and during our sessions. If we believe any participant is under the influence of alcohol or drugs we will refer to our “Rules” located at the top of the terms and conditions page regarding this matter. Alcohol is permitted only after all participants have completed their shooting and as per clubs license agreement or alcohol consumption rules.

IMAGES:

I consent through participating that my image may be captured and then utilised by Hitting Targets and their Authorised Third Parties on digital and printed materials.

PROHIBITED PERSONS:

Hitting Targets does not allow any person/s to participate or attend a Hitting Targets event if you have been deemed a ”prohibited person” under section 3 of the Firearms Act 1996.

VIOLENT OR THREATENING BEHAVIOUR:

Hitting Targets will not tolerate violent or threatening behaviour towards any staff or person/s on the club grounds. Hitting Targets will endeavour to take the correct action to ensure safety at all times.
